TERMS AND CONDITIONS

1. Applicability These terms and conditions apply to all agreements between Dear Diary Tattoo (hereinafter referred to as "we" or "us") and our customers (hereinafter referred to as "you" or "the customer") regarding our services, jewelry, and other products.

2. Address and Registration Dear Diary Tattoo is located at Denneweg 9D, 2514 CD, The Hague. Our company registration number is 90145356.

3. Appointments, Deposit, and Cancellation
   3.1 Customers can make appointments for tattoo and piercing sessions and purchase products through our website or other designated channels.
   3.2 A deposit of €100 is required to secure a tattoo appointment, which will be deducted from the total cost of the tattoo.
   3.3 The deposit is non-refundable, except in the case of cancellation or rescheduling of the appointment by the customer as described in Section 4.

4. Cancellation and Rescheduling of Appointments
   4.1 Customers can reschedule or cancel an appointment while retaining the deposit up to 72 hours prior to the scheduled start time of the appointment.
   4.2 In the event of cancellation or rescheduling of the appointment within 72 hours of the scheduled start time, we reserve the right to retain the deposit as compensation for lost time and any other potential costs.

5. Delivery of Services and Products
   5.1 We will make reasonable efforts to deliver the tattoo or piercing session within the agreed-upon time and on the scheduled date.
   5.2 The customer acknowledges that the final results of the tattoo or piercing session may vary depending on factors such as skin type, aftercare, and individual healing.

6. Sale of Jewelry and Products
   6.1 We strive to provide accurate product descriptions and keep the availability of our jewelry and other products up to date.
   6.2 Customers have the right to return products within 14 days of receiving the order. Products have to be unused and in their original packaging. Ear jewelry and piercings can't be returned due to hygienic reasons. Returns can be made by mail or in our stores. The costs and responsibility for return shipments are borne by the customer unless otherwise agreed upon.
   6.3 Returned products must be in their original condition, unused, and in the original packaging, with all attached labels and accessories.
   6.4 There is a 1-year warranty on jewelry concerning manufacturing defects. Loss of jewelry is not covered by the warranty.

   Loyalty Program
   8.1 After purchasing 6 piercing services, you will receive the next piercing service free of charge.
   8.2 The loyalty card is valid for 1 year from the date of issue.
   8.3 Personal data is processed as described in the privacy policy of Dear Diary Tattoo

    

7. Intellectual Property
   7.1 All intellectual property rights related to the tattoo designs and other creative materials created by Dear Diary Tattoo remain the property of Dear Diary Tattoo.
   7.2 It is not permitted to use, copy, reproduce, distribute, or modify the intellectual property rights without prior written consent from Dear Diary Tattoo.

8. Liability
   8.1 We are not liable for any direct, indirect, incidental, special, or consequential damages arising from the use of our services, products, or the results of the tattoo or piercing session.
   8.2 Our liability is at all times limited to the amount paid for the specific service or product to which the liability relates.

9. Applicable Law and Dispute Resolution
   9.1 All agreements between Dear Diary Tattoo and the customer are governed by Dutch law.
   9.2 Disputes arising out of or in connection with these terms and conditions shall be submitted to the competent courts of The Hague.

10. Gift Card Terms and Conditions

    This gift card ("Gift Card") is issued by Dear Diary Tattoo and can only be used for purchases at Dear Diary Tattoo stores or online at www.deardiarytattoo.com. By using the Gift Card, you agree to the following terms:

    10.1 Validity:

    • The Gift Card is valid until the indicated expiration date on the card.

    10.2 Balance Check:

    • The balance on the Gift Card can be checked in-store or online at www.deardiarytattoo.com.

    10.3 Use:

    • The Gift Card can be used for purchases of products or services at Dear Diary Tattoo.

    10.4 Non-Redeemable:

    • The Gift Card cannot be redeemed for cash or any other form of payment.

    10.5 Remaining Balance:

    • Remaining balance on the Gift Card can be used for future purchases.

    Dear Diary Tattoo is not responsible for the loss, theft, damage, or unauthorized use of the Gift Card.

    10.6 Non-Refundable:

    • Purchases made with the Gift Card are final and not refundable, except as required by law.

    10.7 Suspension or Cancellation:

    • Dear Diary Tattoo reserves the right to suspend or cancel Gift Cards if there are suspicions of fraudulent activity.
